Terms of Sale (Purchase, Shipping & Returns)

1. Who you are buying from
1.1 These Terms of Sale apply when you place an order through the Service. They supplement the Terms of Use; if they conflict on a purchase matter, these Terms of Sale control for that matter.
1.2 You are told each of the following before you pay. Each item is shown on the product page and repeated at checkout for the commerce mode that applies, and — until the on-page role display has shipped for every mode — is stated in the order confirmation you receive:

1.3 Editorial-only pages. Some pages are editorial only: we describe a product but provide no purchase path. Nothing on those pages is an offer to sell.
1.4 When you leave our site to buy. MetaOriental is not a party to your purchase. We provide content, discovery and referral only. Your contract, payment, invoice, tax, delivery, returns, warranty, support and complaints are with the seller you are sent to, under that seller's terms. We are not the manufacturer, importer of record, distributor, retailer or warrantor, and we give no warranty about the product. We may earn a commission on your purchase — see Advertising, Affiliate & Sponsorship Disclosure.
1.5 When the brand is the seller but you check out here. The product page names the brand as Sold by. Your sales contract is with that brand, not with MetaOriental. We provide the storefront, the checkout interface and, through an approved payment provider, the collection of your payment on the brand's behalf. In this mode:
- the brand sets the price, and is responsible for the description, the product itself, delivery, returns, refunds, warranty and after-sales support, on the terms shown on the product page;
- payment is collected by the payment provider named at checkout and settled to the brand;
- the party responsible for collecting and remitting sales tax is named at checkout;
- the brand's own sale terms apply to the contract and are linked from the product page — but Sections 4 to 7 of this document are a minimum floor that those terms cannot go below. Where the brand's terms are silent, Sections 4 to 7 fill the gap. Where the brand's terms give you less than Sections 4 to 7 — a shorter return window, a fee we do not permit, a slower refund — Sections 4 to 7 control and we will honour them. Where the brand's terms give you more, the brand's terms control. (In
OUTBOUND_LINKyou are buying on another company's site and Sections 4 to 7 do not apply at all; the off-site seller's terms govern.)
1.6 What MetaOriental remains responsible for when a brand is the seller. Even though we are not the seller, we are responsible for: operating the checkout and payment interface correctly; disclosing the roles in 1.2 accurately; passing your order and your payment to the right party; routing your complaint, return request or refund request to the brand and following it up; and our own conduct, statements and defaults. If we collected your money and the brand fails to deliver, or fails to pay a refund you are entitled to, contact us at support@metaoriental.com. We will pursue it with the brand, and where we still hold or control the funds we will refund you directly.
1.7 When we are the seller. Where the page identifies MetaOriental Technology Inc. as Sold by, these Terms of Sale form your contract with that entity and every section below applies to us.
1.8 Mixed carts. If your cart contains items sold by different parties, checkout splits them into separate orders with separate confirmations, and the roles in 1.2 are shown separately for each.
2. Orders and acceptance
Applies to every order placed through checkout on the Service, whoever the seller is. Where a brand is the seller, the brand's equivalent terms are linked on the page and apply to the contract, but this Section is the minimum floor under 1.5 — the brand's terms cannot give you less than it. Does not apply in OUTBOUND_LINK, where you order on the seller's own site.
2.1 Your order is an offer to buy. A contract forms only when the seller sends an order confirmation and dispatches the goods, or expressly accepts the order in writing.
2.2 An order may be declined or cancelled, in whole or part, before dispatch, including where: the item is unavailable; a price, description or image is materially incorrect; fraud, resale or abuse is suspected; billing or delivery details cannot be verified; the order would breach export controls, sanctions or product restrictions; or the item cannot lawfully be sold or shipped to your address. If an order is cancelled after payment, you are refunded in full to the original payment method.
2.3 Order limits. Quantities may be limited per customer, per household or per order.
3. Prices, taxes and payment
3.1 Prices are shown in U.S. dollars and exclude sales tax, shipping and any duties unless stated. Applicable taxes and shipping are shown before you confirm.
3.2 Pricing errors. If a price is obviously wrong, the affected order may be cancelled and refunded in full. You will be contacted before that happens where practicable.
3.3 You confirm you are authorized to use the payment method. Payment is captured as disclosed at checkout, by the party named as "Payment processed by."
3.4 Sales tax. Sales tax is calculated on the shipping destination and the applicable rules. The party responsible for collecting and remitting it is named at checkout. Where MetaOriental is required to collect and remit as a retailer or as a marketplace facilitator, we do so.
3.5 Import duties, tariffs and other import charges (cross-border shipments). Some products ship to you from outside the United States. For any such product the product page and checkout state, before you pay: (a) the party acting as Importer of Record; (b) whether the amount you pay includes U.S. import duties, tariffs, customs brokerage, disbursement and related charges ("delivered duty paid"); and (c) if it does not, that the carrier or a customs authority may require you to pay those charges before the parcel is released to you. Where checkout does not expressly state that import charges are included, they are not included, and you may be billed for them separately by the carrier or the customs authority. Where a page states the price is delivered duty paid, the seller named at checkout bears those charges and you must not be asked to pay them; if you are asked anyway, contact support@metaoriental.com — we will route the claim to that seller and, where we still hold or control the funds, reimburse you directly under 1.6.
3.6 Do not assume a low-value shipment is duty-free. United States duty-free treatment for low-value imports has been restricted, and import charges may apply to a shipment of any value. We do not represent that any shipment will clear free of duty, and an estimate of import charges shown at checkout is an estimate — the amount assessed by the customs authority controls.
3.7 Chargebacks. If you believe a charge is wrong, contact support@metaoriental.com first — we will identify the responsible party and help resolve it. Fraudulent chargebacks may result in account suspension and recovery of the disputed amount and costs.
4. Shipping and delivery
4.1 Estimated dispatch and delivery times are shown on the product page and at checkout. They are estimates, not guarantees, except where a binding date is stated.
4.2 Shipping deadline rule. The seller will ship within the time stated, or if no time is stated, within 30 days of receiving your properly completed order. If it cannot ship on time, you will be notified promptly, given a revised shipping date, and offered a clear choice to consent to the delay or cancel for a full and prompt refund. If you do not respond to a notice of delay, the order is cancelled and refunded. This reflects the FTC Mail, Internet, or Telephone Order Merchandise Rule and applies in every mode where checkout happens on the Service, whoever the seller is.
4.3 Risk of loss passes on delivery to your address. Title passes on full payment or delivery, whichever is later.
4.4 Delivery problems. Please report non-delivery, visible damage or a wrong item within 7 days of the delivery date so a carrier claim can be filed in time. Reporting later does not waive your rights — it may make a carrier claim harder, but your rights in respect of a defective, damaged or misdescribed product, and any right that cannot lawfully be waived, are unaffected.
4.5 Shipping is to addresses in the United States unless a page states otherwise. Freight forwarders are not accepted without written agreement.
4.6 Customs clearance, refused parcels and undeliverable shipments (cross-border shipments). For a cross-border shipment, the Importer of Record named at checkout is responsible for clearance. You may be asked to supply information a customs authority requires; if it is not supplied, delivery may be delayed or the parcel returned. If you refuse a parcel, or a parcel is returned because import charges that were disclosed to you before purchase were not paid, the seller may deduct from your refund the actual outbound shipping, return shipping and any non-refundable duties, tariffs or brokerage already incurred, provided each deducted amount was disclosed before purchase and is evidenced on request. No such deduction may be made where the parcel was refused or returned because import charges were not disclosed before purchase, because the product was defective, damaged, misdescribed or shipped in error, or because clearance failed for a reason attributable to the seller or carrier. Where duties already paid are recoverable from the customs authority, we will provide, or require the seller to provide, the documents needed to claim them.
5. Pre-orders, deposits, group buys and crowdfunding
5.1 Where a page is marked pre-order, deposit, group buy or campaign, the following are stated on the page itself: the trigger condition; the deadline at which it is assessed; the estimated ship date and the fact that it is an estimate; refundability and until when; and what happens if the condition is not met.
5.2 If the trigger condition is not met, the campaign is cancelled and 100% of everything you paid, including any deposit, is refunded to your original payment method with no platform, handling or processing fee deducted, within the period stated on the page and in any event within 30 days of the deadline.
5.3 If the ship date moves, Section 4.2 applies: you will be offered the choice to consent to the new date or cancel for a full refund.
5.4 Deposits are recorded separately from the balance. A deposit alone does not create an obligation to ship until the balance is paid and the condition is met.
5.5 Where a campaign runs on a third-party crowdfunding platform, that platform's rules and the campaign owner's obligations apply; the page identifies the responsible party.
5A. Group buys — how the two payments work
Applies to every group buy offered through checkout on the Service. Section 5 applies to group buys as well; this Section sets out the payment mechanics specific to them.
5A.1 A group buy is paid in two stages. You join by paying a deposit — no more than US$5 — which is charged when you join. The rest of the price, the balance, is not charged then and is not authorized against your card then.
5A.2 What the page tells you before you join. The product page states the trigger condition (how many buyers are needed), the deadline by which it is assessed, the deposit amount, the balance amount, the estimated ship date, and the fact that the balance becomes payable only if the group succeeds.
5A.3 If the group does not reach its target by the deadline, the group buy fails, your order is cancelled, and your deposit is refunded in full to your original payment method, with nothing deducted. Section 5.2 governs the timing.
5A.4 If the group reaches its target, we email a payment request for the balance to the address on your order, stating the amount and the date by which it must be paid, with a link to pay it. Nothing ships until the balance is paid.
5A.5 If you do not pay the balance by that date, the order is cancelled and your deposit is refunded in full to your original payment method, with nothing deducted. You are not charged the balance, no fee is taken from the deposit, and there is no other consequence for you. We will send at least one reminder before the deadline passes.
5A.6 If the ship date moves after the balance is paid, Section 4.2 applies: you will be told promptly, given a revised date, and offered the choice to consent to it or cancel for a full and prompt refund of everything you have paid, deposit included.
5A.7 Your deposit is never forfeited. In every outcome above — group fails, balance unpaid, ship date rejected, order cancelled before dispatch — the deposit comes back to you in full.
6. Returns and cancellations
6.0 The return policy that applies to your order is shown on the product page before you buy and is repeated in your order confirmation. The rules below are MetaOriental's policy where we are the seller, and — under 1.5 — a binding minimum floor for any brand selling through checkout on the Service: a brand's own terms may give you more than this Section, never less.
6.1 Change-of-mind returns. Most new, unused items in original packaging with all accessories may be returned within 30 days of delivery for a refund of the purchase price. Where a specific product has a different change-of-mind window, that window is stated on the product page before you buy and may not be shorter than 14 days.
6.2 How to return. Start a return by contacting support@metaoriental.com — in every mode, including where a brand is the seller. We will issue the return authorization or route your request to the brand and follow it up under 1.6. Do not ship anything back without a return authorization; unauthorized returns may be refused.
6.3 Return shipping. For change-of-mind returns you pay return shipping unless the page says otherwise. For items that arrive damaged, defective, materially different from the description, or shipped in error, return shipping is paid for you and there is no restocking fee.
6.4 Restocking fee. A restocking fee of up to 15% may apply to change-of-mind returns of opened items, and must be disclosed on the product page before you buy or it does not apply. No restocking fee applies to defective, damaged or misdescribed items.
6.5 Non-returnable items. Items that cannot be returned for hygiene, safety or legal reasons — including opened personal-care, in-ear and hygiene-sensitive products, consumables, and items with activated software licences or transferred accounts — are labelled as such before purchase.
6.6 Refund timing. Refunds are issued to the original payment method within 10 business days of receipt and inspection of the returned item, or of the decision where no return is required. Your bank may take additional time to post the credit. Where a brand is the seller and the refund has not reached you within that period, contact support@metaoriental.com — see 1.6.
6.7 Cancellation before dispatch. Any order that has not yet been dispatched may be cancelled for a full refund.
6.8 Cross-border returns. Where a return must be shipped outside the United States, the return address, who pays return shipping, any export or re-import formality you must complete, and whether import charges you paid are refundable, are stated on the product page before you buy and repeated in the return authorization. If they are not stated, return shipping for that order is at the seller's cost and no restocking fee applies. Where the product is defective, damaged, materially different from the description or shipped in error, return shipping and any return-related import charge are at the seller's cost in every case, including cross-border returns (see 6.3).
7. Warranty
7.1 Products carry the manufacturer's warranty, if any. The product page states its length and scope and names the party providing warranty service.
7.2 We will help you reach the manufacturer or the seller for a warranty claim. Warranty service, parts and repair decisions are the manufacturer's or the seller's.
7.3 Nothing in these Terms of Sale limits any non-excludable statutory right you have as a consumer, including implied warranties that cannot lawfully be disclaimed in your state and rights under the Magnuson-Moss Warranty Act.
7.4 Where MetaOriental is the seller: except for the manufacturer's warranty and any non-excludable statutory rights, products are sold "as is" and we disclaim implied warranties of merchantability and fitness for a particular purpose to the fullest extent permitted by law. This disclaimer does not apply in states that do not permit it.
8. Product safety, recalls and restricted products
Applies in every mode.
8.1 Read and follow the manufacturer's instructions, warnings and age restrictions. Many products in our categories include lithium-ion batteries, powered motion, rotating blades, lasers, heating elements or airborne operation.
8.2 Some products are restricted by federal, state or local law, or by carrier rules. It is your responsibility to confirm the product is lawful to own and use where you live and how you intend to use it.
8.3 If a product is recalled, the party named as the safety and recall contact on your order will notify you; we will also make reasonable efforts to notify purchasers using the contact details on the order, whoever the seller was, and will publish notice at Product Safety & Recalls. Follow the manufacturer's or CPSC's remedy instructions.
8.4 Report a safety concern at Report a Safety Issue, or directly to the U.S. Consumer Product Safety Commission at SaferProducts.gov. Reporting to us does not replace, and does not delay, any report you wish to make to a regulator.
8.5 Reporting duties are not allocated by this document. Manufacturers, importers, distributors and retailers each carry their own statutory duties. See Product Safety & Recalls §7.
9. Products are not medical devices
Unless the manufacturer's own labelling states that a product is FDA-cleared or FDA-approved for a specific use, it is a general consumer product and is not intended to diagnose, treat, cure or prevent any disease. See the Health & Wellness Disclaimer.
10. Limitation of liability
10.1 There is one liability regime, and it is in the Terms of Use. Our liability to you follows Terms of Use §14 — including its exclusion of indirect and consequential loss (§14.1) and its carve-outs (§14.3). This Section states only what is specific to a purchase.
10.2 Cap for a product purchase. For a claim arising from a product you bought, our total liability will not exceed the amount you paid for that product including any shipping you paid for it; where that amount is lower, the US$100 floor in Terms of Use §14.2 applies, so the cap is the greater of the two.
10.3 What our liability attaches to. Where MetaOriental is the seller, it attaches to the sale. Where a brand is the seller, it attaches to our own role — the checkout, the disclosures, the handling of your payment and of your request — and not to the product itself or the brand's performance, except for the commitments we make in 1.6.
10.4 The cap in 10.2 does not apply to refund obligations under these Terms of Sale, or to anything listed in Terms of Use §14.3 — our fraud, wilful misconduct or gross negligence; liability for death or personal injury caused by negligence; and any liability that cannot lawfully be limited, including under applicable product liability and consumer protection law.
11. Export, sanctions and end use
The export and sanctions representation you give is stated once, in Terms of Use §21.9, and applies to your purchases. In addition, and specific to goods: you will not export, re-export or transfer any product you buy in violation of U.S. export control or sanctions law, and an order may be declined or cancelled under 2.2 where it would breach those rules.
12. Disputes
12.1 Section 19 (arbitration and class action waiver) and Section 20 (courts) of the Terms of Use apply to disputes between you and MetaOriental about a purchase, including the 30-day informal-resolution requirement and your right to opt out of arbitration within 30 days.
12.2 A dispute with a brand seller is with that brand, under the brand's own terms; we will provide the brand's contact and dispute details on request and will assist as described in 1.6.
